DCA Consultation : Increasing sanctions for wilful misuse of personal data
The government proposes introducing custodial sentences for those engaged in the deliberate and wilful misuse of personal data and is carrying out a consultation on the proposals.

The consultation follows on from the recent ICO report 'What Price
Privacy?' which criticises private investigators (often instructed by
journalists and others, including insurers) for procuring information
using underhand methods, such as 'blagging'. The information
Commissioner called upon Government to introduce tougher penalties in
order to provide an adequate deterrent. The ABI is currently preparing
guidance for insurers to promote best practice amongst practioners
instructing PIs.
